TrafficCast International, Inc. (“TrafficCast”) operates and manages a mobile application (“The App”) and associated website which provides traffic and travel information focused on the needs of daily commuters. While The App may be promoted by, associated with, or co-branded through independent media affiliates and partners, TrafficCast controls the app itself. In this statement of Terms of Service for The App, the expressions “we,” “us,” and “our” refer to TrafficCast; “you” refers to you, as a user of the mobile application, The App.


You are solely responsible for your conduct and your data related to The App and its Services. You agree to indemnify, defend and hold harmless TrafficCast and its suppliers from any and all loss, cost, liability and expense arising from or related to your data, your use of The App and its Services or your violation of the Terms of Service, or this Policy.


The App and its Services are made available to you only for personal use, which must be in compliance with all applicable laws, rules and regulations and must not infringe or violate third party rights.


Any unauthorized use of The App or its Services is a violation of this Agreement and certain federal and state laws. Such violations may subject the unauthorized user and his or her agents to civil and/or criminal penalties.


Things You Should Do with The App:


Play nice – The App enables a community of commuters to keep each other informed. This community includes all sorts of people, who all have the right to feel comfortable and who may not agree with everything you think or believe. If you happen to interact directly with any members of The App community, be polite and respectful.


Only share content you create – Respect the copyright of others. Please don’t pass on information that you have seen or heard from another source – either a private individual or a public entity – as your own. We welcome updates to road conditions that may have been originally reported elsewhere, but please don’t pretend to be a source of information when it should be obvious you are not.


Only share content that might be valuable to other commuters – which means information road conditions, obstacles, construction, backups, congestion and the like. The App is not a forum for self-promotion, politics, religion, sports or similar comments – there are plenty of websites and mobile apps for that.


And as you no doubt know, there are things you should not do with The App:


You will not probe, scan or test the vulnerability of any system or network, or otherwise breach or attempt to circumvent any security or authentication measures.   In particular, you will not access, search or create accounts for The App by any means other than our publicly supported interface(s). For example, you will note “Scrape” or create accounts in bulk.


You will not access, tamper with or use non-public areas or parts of The App and its Services, or shared areas of The App you have not been invited to use, or have registered to use. You will not interfere with or disrupt any user, host or network by, for example, sending a virus, overloading, flooding, spamming or “mail bombing” any part of the Services.


You will no send unsolicited communications, promotions, advertisements or spam using The App, and will not promote or advertise products and services without appropriate authorizations. You will not send altered, deceptive or false source-identifying information, including “spoofing” or “phishing”.


You will not resell The App or its Services or its Content unless specifically authorized to do so by TrafficCast.


You will not violate the law in any way, including storing, publishing or sharing material that is fraudulent, defamatory, misleading or violate the privacy or infringe on the rights of others. You will not share materials that are pornographic or indecent, or that contain extreme acts of violence, or advocate bigotry or hatred against any person or group of persons based on their race, religion, ethnicity, sex, gender identity, sexual preference, disability or impairment.
